By accessing or using the Botanicaly app, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service.

2. Description of Service

Botanicaly is a plant care companion app that provides AI-powered plant identification, care tracking, and weather-based recommendations functionality.

3. User Accounts

• You are responsible for safeguarding the password that you use to access the service.
• You must provide accurate and complete information when creating an account.
• You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
• You may not use as a username the name of another person or entity or that is not lawfully available for use.

4. Acceptable Use

You agree not to use the service to:

• Violate any local, state, national, or international law.
• Infringe upon the rights of others.
• Interfere with or disrupt the service or servers.
• Upload malicious code, viruses, or harmful materials.

5. AI & Plant Identification

The plant identification feature uses Google Gemini AI. While we strive for accuracy, the results should be considered educational recommendations rather than definitive expert advice. Never consume or touch unknown plants based solely on the app's identification.

6. Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of Botanicaly and its licensors. The service is protected by copyright, trademark, and other laws.

7. Disclaimer of Warranties

Your use of the service is at your sole risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the service will be uninterrupted, timely, secure, or error-free.

8. Limitation of Liability

In no event shall Botanicaly, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages resulting from your use of the service.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any significant changes by updating the date at the top of these terms.

10. Pro Subscription & Fair Use

Botanicaly Pro is a subscription that unlocks premium features. To prevent abuse and protect service availability for all users, AI-powered features (plant identification, plant doctor, light meter, plant chat) include generous daily fair-use limits that are not visible during normal use. If you exceed these limits, the feature pauses until the next day. We reserve the right to adjust limits to maintain service quality.
